Club By-Laws
1.0 CHILDREN
1.1
Children shall not be permitted into Club premises and its surrounding grounds or to use any facilities of the Club unless they are accompanied by an adult Member.
1.2
Children are permitted to use the clubhouse facilities up to 10:00pm with the exception of areas determined by the Management.
1.3
Children may only be permitted to sign for facilities or privileges if their parents have authorised them to have a Membership Card and have the signing rights.
1.4
Children are not permitted to consume any alcohol whilst in the Club premises.
1.5
Parents bringing their children to the Club shall do so at their own risk and without liability of any sort on the part of the club and they shall be entirely responsible for the acts and conduct of their children.
1.6
Upon a complaint regarding the conduct of any child, the Management may on being satisfied that there has been a breach of the Rules or By-Laws, temporarily withdraw the facilities conferred on the child by these Rules or any other By-Laws pending the decision of the Board.
1.7
The Management will not be responsible for any missing child or death or injury caused to or suffered by any child in the Club premises.
2.0 GOLF
2.1 GENERAL
2.1.1
The rules of the game of golf shall be those currently adopted by the Royal and Ancient Golf Club of St. Andrews (R&A) and the United States Golf Association (USGA).
2.1.2
Local rules shall be printed on the scorecard and changes shall be posted on the golf notice board from time to time.
2.1.3
The Management may, at its absolute discretion, delegate any of its powers relating to the use of the Golf Courses to such person(s) or committee(s), as the Management shall deem fit.
2.1.4
The Management shall be authorised to vary the control of play and the starting times regulated by a time sheet, whenever necessary.
2.1.5
Golfers with valid handicap may use the Golf Courses on such days and times as the Management may decide and upon such terms as the Management shall determine.
2.1.6
Members and guests are required to purchase golf insurance coverage against third (3rd) party liability, personal injury, damage and/or loss of personal effects.
2.1.7
Members must produce their Membership cards to the Registration Clerk upon registration.
2.1.8
Members and guests must produce their identification tags when requested to do so by an employee of the Club or any other person(s) authorised by the Club.
2.1.9
The Management may at any time reserve or close the whole or part of the Golf Courses for any reason whatsoever.
2.1.10
All golfers must have a valid handicap before they are allowed to play, unless permitted by Management.
2.1.11
Sharing of golf Clubs is prohibited.
2.2 IDENTIFICATION
2.2.1
An official golf identification tag shall be displayed by all Members whilst on the Golf Course. The tag should be displayed In a prominent part of the golf bag and shall be available for inspection upon request by the Management, Starters, Course Marshals, and/or other such authorised personnel.
2.2.2
Visitors from Clubs with reciprocal arrangements and duly authorised non-members/guest(s) whilst on the Golf Course must each display clearly and appropriately visitor's tag as in By-Law 2.2.1
2.3 ELIGIBILITY TO PLAY
2.3.1
Golfers without a valid handicap or whose handicap is above 24 (men) and 36 (ladies) shall not be entitled to play on KLGCC Golf Course.
2.3.2
Subject to the provision of By-Laws 2.3.1 all guest(s) must produce a valid handicap card/certificate before commencing play at the Golf Course.
2.4 GENERAL ETIQUETTE
2.4.1
No golfer shall commence play until the golfers in front are out of range.
2.4.2
Players should not stand close to the edge of the hole or damage the green or drag their feet while walking thereon.
2.4.3
Golfers shall at all times repair divot and pitch marks, and rake the bunkers during play.
2.4.4
Players shall play at a good pace and should not delay their play. In the event of slow play, golfers should allow the faster golfers to pass through.
2.4.5
Searching for golf ball should not exceed five (5) minutes. Any ball that cannot be found within such time must be declared as a “Lost Ball” and golfers shall resume play immediately.
2.4.6
The Course Marshal/Steward shall have the right to direct slow players to the next tee in the event of slow play.
2.4.7
Before making a practice swing, golfers should ensure that no one is standing close by or in a position to be hit by the Club, ball or any other material which may be moved by the stroke or swing.
2.4.8
In taking practice swings, golfer(s) should avoid taking divots, particularly on the tee boxes.
2.4.9
Golfers are to dispose their rubbish (including cigarette butts) in the bins provided in/or around the Golf Course and Clubhouse. Failing to do so, Member(s) will be fined a minimum of Fifty Ringgit (RM50) for each offence and Disciplinary action will be taken against the Member(s).
2.5 DRESS CODE
2.5.1
Members and their guest(s) shall be in appropriate attire at all times while on the Golf Courses, Practice Greens, Practice Bunker and at the Driving Range.
2.5.2
The minimum appropriate attire for men is tailored shorts or trousers, golf shirt with sleeves and collars and soft non marking shoes with socks. Sleeveless shirts/t-shirts is strictly prohibited.
2.5.3
The minimum appropriate attire for ladies is skirts or shorts, blouses with sleeves or sports shirts with collars and soft non marking shoes with socks. Sleeveless shirts/t-shirts or blouses is strictly prohibited.
2.5.4
Jeans and tracksuits are not permitted to be worn in the Golf Course.
2.5.5
The Management or any authorised employee of the Club shall have the authority to stop a player from playing if he/she is unsuitably attired.
2.6 GUESTS
2.6.1
Guests shall be required to produce a valid handicap card before they are allowed to play in the Golf Course.
2.6.2
The host Member must play with their guests and be responsible for the verification of their guests handicaps.
2.6.3
Members shall be responsible for all expenses incurred by their guests.
2.6.4
Members are to ensure that their guest(s) observe the Rules and Regulations of the Club and shall further be responsible for the behaviour and conduct of their guest(s).
2.6.5
In the event the Member fails to observe the provision herein, such Member shall be liable to pay double the rate of green fees payable to the Club and may be subject to disciplinary proceedings.
2.6.6
Unless otherwise determined by Management, Members are allowed to introduce guest(s) based on the following:
East Course - A maximum of seven (7) guests
Referred guest(s) may either be accompanied or unaccompanied.
West Course - Weekdays
- A maximum of three (3) guests
- Weekends & Public Holidays
- Only one (1) guest
Guests must be accompanied at all times.
2.6.7
Children cannot introduce guest(s) to play golf at all times.
2.7 GREEN FEES AND OTHER CHARGES
2.7.1
All players shall be liable to pay such fees as may be determined by the Management from time to time and displayed by the Management at conspicuous part of the Club premises, for the use of the Golf Courses and its related activities.
2.7.2
For eighteen (18) holes game, a rain cheque for nine (9) holes green fee will be issued if a game is abandoned after completion of five (5) holes.
2.7.3
For eighteen (18) holes game, a rain cheque for eighteen (18) holes green fee will be issued if a game is abandoned after completion of four (4) holes or less.
2.7.4
If a golf game is abandoned due to inclement weather during the day, Members and guests may, in lieu of rain cheques, elect to continue to play during the night if there is night golfing on that particular night and subject to night levy
2.8 BOOKING ARRANGEMENT
2.8.1
Bookings shall be open from 6:45am every Monday for all tee-off times on Saturday, 6:45am every Tuesday for all tee-off times on Sunday; and 6:45am every Wednesday to Sunday for all tee-off times from Monday to Friday of the following week.
2.8.2
Bookings may be made via telephone, walk-in or through KLGCC online portal on such days and within hours as shall be determined by the Management from time to time and posted at a conspicuous part of the Club premises. Telephone bookings can only be made after 9:00am.
2.8.3
Each Member shall be entitled to only one (1) booking for each day of play. No Member may book on behalf of another Member. Children of Member(s) are not permitted to make booking.
2.8.4
When making a booking, Member shall provide their name(s) and Membership numbers and the name of the other players in the flight and their approved handicap.
2.8.5
The Member making the booking shall be responsible for the non-appearance of any of the players on his/her flights and be liable for the payment of the no show fees of RM 315.00.
2.8.6
The Member who made the booking shall be solely responsible for the non-appearance of any of the players on the same flight.
2.8.7
The Management reserves the right to allow other players to tee-off for booking(s) not taken up.
2.8.8
The above By-Laws apply to spouse(s) of Members.
2.8.9
Corporate bookings – The Management may at any time and from time to time by notice reserve the whole or any part of the Golf Course for such purpose.
2.9 CONTROL OF PLAY
2.9.1
Subject to the approval of the Management, the Golf Manager shall be authorised to make amend or vary the rules pertaining to the control of play.
2.9.2
All golfers and guests should report to the Golf Registration Centre at least thirty (30) minutes before the tee-off time and be at the tee-box at least ten (10) minutes before the tee-off time.
2.9.3
All players shall ensure that they tee-off at their assigned time and shall not delay their play.
2.9.6
Minimum three (3) golfers per flight are permitted on weekends, public holidays and for night golfing. As for two (2) players per flight, it shall be at the discretion of the Management.
2.9.7
A golfer may not play more than one ball at any time in the Golf Courses.
2.9.8
Non golfers may not accompany golfers in the Golf Courses.
2.9.9
Only Members' guests with a valid handicap are allowed to play on the West Course.
2.9.10
Undue Delay/Slow Play
Players searching for a ball should signal the players behind them to pass as soon as it becomes apparent that the ball will not be easily found after a search of not more than five (5) minutes. They should also not continue play until the players following them have passed and are out of range.
If the group ahead is slowing down the group behind with one (1) clear hole then the group behind shall be allowed to pass and play through in the same manner as 2.9.5
Players are expected to assist and cooperate with the Officials and Course Marshalls in their attempts to expedite the play of any group of players.
2.9.11
Issue and return of score cards – Score cards will be issued to each golfer. All score cards issued must be properly completed and signed by every golfer concerned and returned to the boxes provided for handicap purposes without delay upon completion of the round. All golfers are therefore reminded not to lose or throw away any such score cards regardless of the number of holes played for any reason, including cancellation of play due to bad weather.
2.10 CLOSURE OF GOLF COURSE
2.10.1
Play in the Golf Courses shall be regulated by siren as follows:
One (1) continuous blast of one (1) minute – Stop Play
Two (2) continuous blasts of one (1) minute – Abandon Play
Three (3) short blasts – Resume Play
2.10.2
Any golfer(s) who continue play when a Golf Course is closed may be subject to disciplinary action.
2.11 CLUB COMPETITIONS
2.11.1
Eligibility for Club competitions shall be confined to Members with an official Club handicap.
2.11.2
The dates, times, courses and entrance fees for all competitions shall be determined by the Management.
2.11.3
Competitors taking part in a Club competition shall have priority on the Golf Courses and other players shall permit competitors to pass through.
2.11.4
The scores shall be recorded during the course of play and the scorecard countersigned by a marker appointed by the Management or the player's opponent.
2.11.5
In competitions extending over more than one (1) day, the Management may at any time on the first day declare play cancelled if it considers that the course is not playable for any reason or that proper play is impossible due to insufficient light. If play is not declared cancelled by the Management on the first day, and the Course is closed on any subsequent day, the competition shall be decided on the play that had taken place on the previous day.
2.11.6
Before the start of a competition, all competitors shall sign their names as competitors in the manner provided for and shall comply at all times with the rules of the competition. Any competitor(s) failing to observe this Rule shall be automatically disqualified.
2.11.7
All Club competitions shall be governed by the RAGC, USGA and the Local Rules of KLGCC.
2.11.8
A member who fails to report to the golf registrations office twenty (20) minutes before starting time shall be deemed to have withdrawn from the competition, and the Management may proceed to fill in his/her slot the first name available on the reserve list.
2.11.9
Stroke competitions shall, unless the context otherwise requires, include “Bogey” and “Stableford” competitions and the qualifying rounds of other competitions in which match play is not involved.
2.11.10
In scratch competitions to be decided by match play, the Management shall have the right at its discretion to seed players.
2.11.11
In competitions in which a draw is made, no competitor may, unless the Management otherwise decides, play at a time other than that fixed by the Management. A competitor in any competition who fails to appear on the starting tee at the appointed time or when called, shall be disqualified, and shall nevertheless be debited with double the cost of the of the entrance fee and be precluded for a period of two months from entering any competition of the Club in which a draw is made, unless, 48-hours prior notice or an explanation in writing satisfactory to the Management is given. After the entries are closed in any competition and a draw made, no further entry will be accepted.
2.11.12
In all competitions involving individual stroke play, players shall return their cards whether completed or not at the conclusion of play. Any player who fails to comply with this Rule shall not be eligible to enter any other competition unless otherwise decided by the Management.
2.11.13
In match play, it shall be the duty of the winner to see that the result is duly reported.
2.11.14
Ball sweeps shall be held on such competitions and upon such conditions as the Management may decide, either in respect of the whole competition or in respect of any of the nine holes thereof. A competitor disqualified from a competition shall also be disqualified from the ball sweeps.
2.11.15
In the event of a tie in match play competitions, the Club's count back system shall be applicable.
2.11.16
The Club's count back system shall start with hole 10 to 18 and if a tie still results, with 13 to 18, 16 to 18, 17 to 18 and last hole 18, and thereafter similarly on the first nine.
2.12 CADDIES & BUGGY
2.7.1
All players shall be liable to pay such fees as may be determined by the Management from time to time and displayed by the Management at conspicuous part of the Club premises, for the use of the Golf Courses and its related activities.
2.7.2
For eighteen (18) holes game, a rain cheque for nine (9) holes green fee will be issued if a game is abandoned after completion of five (5) holes.
2.7.3
For eighteen (18) holes game, a rain cheque for eighteen (18) holes green fee will be issued if a game is abandoned after completion of four (4) holes or less.

2.12.1 Caddies
All golfers shall hire caddies at the prescribed rate save when insufficient caddies are available.
No booking or selecting of caddies is permitted.
Caddies are not permitted in such areas of the Club as shall be determined by the Management from time to time.
Caddies are not permitted to run errands for Members or guest(s).
The Management shall not be responsible for cash or valuables entrusted to the caddies by the golfers or kept in the golf bag.
Any complaint against caddies shall be made in writing to the Management immediately after the incident.
2.12.2 Buggies
All golfers shall be required to use buggies in the Golf Courses, unless otherwise permitted by the Management.
No booking of buggies is allowed.
Buggies must be collected and returned to the Buggy Station immediately after use.
Children are not permitted to drive buggies.
The hirer is responsible for all damages to the buggy and will bear the cost of making good the buggy.
In conserving the fairway, the Management may restrict buggies to such paved buggy path for such periods as the Management deem suitable and during such periods of restrictions, all players must comply with this Rule. At all times, buggies are prohibited in the following areas:
On the tee-box
Over the slopes of bunkers
Sprinkler heads and covers
Flower beds/shrubs/drink huts
On and around the green and fairway
Golfers between the ages of twelve (12) and sixteen (16) years must obtain a buggy competency certificate from the Management.
2.13 GOLF HANDICAP
2.13.1
All golfers shall be required to produce a valid handicap card before they are allowed to play on the Golf Courses.
2.13.2
Golfers without valid handicap shall be required to produce a golf proficiency certificate to play on the Golf Courses.
2.13.3
Golfers twelve (12) years and below and with a proficiency certificate shall be accompanied at all times by an adult with a valid handicap.
2.13.4
Members with a valid handicap from other Clubs shall be recognised.
2.13.5
Members' handicaps shall be computed in accordance with the current USGA handicapping system and the recommendations of MGA. Such handicaps shall be printed in the Handicap Register monthly.
2.13.6
The Management may at its discretion, revise or suspend the official handicap of a Member at any time.
2.13.7
The revision of official handicaps shall, unless otherwise determined by the Management, be in accordance with the recommendations of the MGA and USGA handicap system.
2.13.8
The Management shall or upon recommendation of the Handicap Committee, have the right to revise (upwards or downwards) a handicap if the player's performance justifies it, as per “Handicap Revision Table” below.
2.13.9
When a handicap is cut or reduced voluntarily or in accordance with Rule 2.13.8 hereof, the revised handicap shall remain unchanged for a period of three (3) months and constitutes, during such period of time, the official handicap of the Member unless the actual handicap is lower.
2.13.10
Members are required to submit a score card every time a round of 18-holes is played whether at any of the Club's Courses or elsewhere, which shall include the following information:
Member's name and Club Membership number;
Member's current or official handicap, whichever is lower;
Date round played;
Course Rating;
Slope Rating;
18-hole score
National handicapping system number
2.13.11
All scorecards submitted shall be signed by the Member concerned and countersigned by a marker. If a Member fails to submit a card, the Management shall submit a card on his/her behalf with a nett score below the Course Rating, the number of which shall be decided by the Management. For handicap purposes, the Management will accept scorecards up to a maximum of five (5) incomplete holes per round. Any incomplete hole should be clearly marked.
2.13.12
Notwithstanding the provisions of Rule 2.13.4 herein, the Management may at its discretion award a new Member a current handicap provided that such Member produces a recently dated handicap certificate issued by another Club bearing an authorised signature. Such Member shall be given an official handicap when he returns twenty (20) complete 18-hole rounds.
2.13.13
Any Member failing to submit a scorecard in accordance with Rule 2.13.10 for a period exceeding six (6) months shall have his/her name removed from the handicap list and kept on the non-active list. As soon as he/she submits a new scorecard of 18-holes within the next twelve (12) months, his/her handicap will be reinstated but shall be current. When he/she has submitted ten (10) score cards, he/she shall be given an official handicap. In the event the Member fails to make a return within fourteen (14) months, his/her handicap record will be removed from the handicap register. Thereafter, the Member shall be required to obtain a new handicap.
2.13.14
Members applying for new current handicaps shall return ten (10) complete 18-hole cards played over any of the Club's Courses. Nine (9) hole cards played over any of the Club's Courses are acceptable provided each full nine (9) holes are played on the same course within 48-hours. All cards must be signed by the Member and by a marker who shall be a Member with a valid handicap.
2.13.15
A Member may be called upon to play up to nine (9) holes of golf with a nominated Member of the Handicap Committee during which the standard of the Member's play and his compliance with the Rules & Regulations of the Club and Etiquette of golf will be assessed and if the Member meets the required standard, the Member will be awarded a current handicap and shall be so notified in writing.
2.13.16
If the Member does not meet the required standard he/she shall not be awarded a new handicap and he/she shall become eligible to be tested again only upon the expiry of one (1) month from the previous test.
2.13.17
Any Member shall be entitled, on request, to be issued with a handicap certificate stating his current handicap and signed by the Management.
2.14 INTER-CLUB MATCHES
2.14.1
Open to all KLGCC Members unless otherwise determined by the Management.
2.14.2
Selection is on first-come-first-served basis.
2.14.3
Members selected must attend lunch/dinner after the game and be dressed appropriately.
2.14.4
Members competing in Inter-Club Matches must wear designated KLGCC Inter-Club t-shirts.
2.14.5
Members who are found to be absent from any inter-club matches, or not abiding by the above rules without any valid reason, will be banned for the next two (2) inter-club matches.
2.15 KLGCC MONTHLY MEDAL
2.15.1
Open to all KLGCC Members with a valid handicap unless otherwise determined by the Management.
2.15.2
The competition shall be decided over 18 holes on either Stroke Play or Stableford. Competitor with the lowest Nett score or highest Stableford points shall be announced the winner.
2.15.3
All ties shall be decided on count back.
2.15.4
Entries and selection are on first-come-first served basis.
2.15.5
The number of prizes and value of the prizes shall be decided by the Management.
2.15.6
No competitor shall win more than one (1) prize.
2.16 KLGCC PRESIDENT'S TROPHY
2.16.1
Open to all KLGCC Members with a valid handicap unless otherwise determined by the Management.
2.16.2
The competition shall be decided over 18 holes Stroke Play. Competitor with the lowest Nett score shall be announced the winner.
2.16.3
All ties shall be decided on count back.
2.16.4
Entries and selection are on first-come-first served basis.
2.16.5
The number of prizes and value of the prizes shall be decided by the Management.
2.16.6
No competitor shall win more than one (1) prize.
3.0 DRIVING RANGE
3.1 OPERATING HOURS
3.1.1
The driving range operating hours shall be from 8:00am to 11:00pm from Monday to Friday and 7:00am to 10:00p from Saturday to Sunday and Public Holidays. During maintenance on alternate Mondays, the operating hours shall be from 4:00pm to 11:00pm. The Management reserves the right to close the driving range at anytime at its discretion.
3.2 PRACTICE GREENS
3.2.1
Range balls are strictly prohibited on Practice Greens.
3.2.2
Members and Visitors patronizing the Practice Greens must be suitably attired. Sleeveless shirts, jeans and slippers are strictly prohibited.
3.2.3
Chipping and putting are only allowed at designated Practice Greens as shall be determined by the Management.
3.3 GENERAL
3.3.1
Only one (1) player is allowed to occupy each bay during each time slot and utilisation is on first-come-first-served basis.
3.3.2
Golf balls may be hired at such rate as shall be stipulated by the Management from time to time and posted on the Notice Board.
3.3.3
Guest(s) shall be charged a fee as may be determined by the Management for the use of the Driving Range facility.
3.3.4
No coaching is allowed unless conducted by the Club's golf professionals.
3.3.5
The Management reserves the right to refuse entry or request any person(s) to leave the Club premises if in the opinion of the Management, the conduct or act of such person causes annoyance and disturbance to other person(s) using the Driving Range facilities.
3.3.6
The Management shall not be liable for any mishap or injury to person or persons, damage to or loss of property and/or belongings in or around the Golf Courses, Practice Greens, Practice Bunker and/or Driving Range by any cause whatsoever.
3.4 DRESS CODE
3.4.1
Members and Visitors patronizing the Driving Range and Practice Green must be properly attired. Sleeveless shirts, jeans and slippers are strictly prohibited. The Management or any authorised employee of the Club shall have the authority to refuse entry or remove any person(s) from the Club premises if he/she is unsuitably attired.
4.0 SQUASH, TENNIS AND BADMINTON COURTS
4.1
The squash, tennis and badminton areas includes the courts, gallery and access to the courts and is for use by Members, guests and others authorised by the Management from time to time and within the general framework of the Club's Rules and By-Laws.
4.2
Squash, tennis and badminton courts shall be open at such hours and on such days as the Management shall determine from time to time. Notice of the opening hours shall be posted at a conspicuous part of the Club premises in the vicinity of the courts.
4.3
The Management may at any time, close the squash, tennis and badminton courts or any part thereof for any reason whatsoever.
4.4
Members are obliged to produce their Membership Cards when requested by the Management or any authorised employee of the Club.
4.5
Guest(s) must be registered and pay the appropriate fee at the Golf & Sports Counter before using the facilities. Guest(s) must be accompanied by Member(s) at all time.
4.6
Children below fifteen (15) years old are not allowed to use any of the racquet games facilities except with parental/guardian supervision.
4.7
No smoking, eating or drinking is permitted in the courts and the playing areas.
4.8
Only approved types of equipment shall be used. Racquets with sharp edges, which are not protected, are not permitted.
4.9
Lessons are to be conducted by the Club's qualified and authorised coaches and/or instructors only.
4.10
Members shall be required to sign for lesson fees at the Sports Department prior to the commencement of each lesson and any direct payment to the coach or instructor is prohibited.
4.11
The Management shall not be liable for any mishap or injury to, person or persons, damage to or loss of property/belongings in or around the courts by any cause whatsoever.
4.12 DRESS CODE
4.12.1
Members and Visitors patronizing the squash, tennis and badminton courts must be properly attired. Sleeveless shirts, jeans and slippers are strictly prohibited. The Management or any authorised employee of the Club shall have the authority to refuse entry or remove any person(s) from the Club premises if he/she is unsuitable attired.
4.12.2
Only shoes with non-marking soles are allowed. Shoed with studs or spikes or black soles (e.g. jogging shoes) are not permitted.
4.13 GENERAL BOOKING PROCEDURE
4.13.1
Unless otherwise determined by the Management, all courts may be booked on an hourly basis at such time as the Management shall decide. Booking may be made in person at the Golf & Sports Office or by telephone during operating hours.
4.13.2
Members are required to submit their names and Membership numbers when making a reservation.
4.13.3
Booking may be made up to three (3) days in advance. Each Member is permitted to book only one (1) court for each session of play.
4.13.4
Any Member wishing to cancel his/her booking must do so at least four (4) hours prior to his/her playing time failing which a cancellation fee will be charged and debited to his/her account.
4.13.5
Any Member who fails to take up a reserved court for three (3) consecutive occasions or more shall be barred from making any further booking for a continuous period of one (1) calendar month.
4.13.6
Any reserved court not taken up within five (5) minutes by the Member who made the booking will be made available to other Member(s) and a penalty fee stipulated by the Management shall be debited to the account of the Member making the booking.
4.13.7
As courtesy to other Members, players must vacate the courts when their session of play ends. Extension of playing times may be made at the Driving Range Counter or Golf & Sports Counter.
4.13.8
Children are not permitted to book courts but may play on available courts, which they will have to vacate immediately when required by Members.
4.13.9
Booking for solo play is strictly not allowed.
4.13.10
If a Member's partner fails to turn up and the Member does not intend to choose another partner, he/she will forfeit his/her booking.
4.13.11
Member's guest who uses the sports facilities shall be imposed a fee.
4.13.12
Booking will not be allowed at times declared as sessions for Club play and matches organized by the Management. Due notice will be given for such sessions.
4.13.13
The Management reserves the right to cancel bookings for breach of any of these By-Laws, or if the courts are needed for special events not within the meaning of By-Law 4.13.12
4.13.14
Persons under the influence of alcohol or drugs are not permitted to use the courts.
5.0 SWIMMING POOL
5.1
The swimming pool facilities shall be open at such time and such days as shall be posted on the Notice Board by the Management from time to time.
5.2
The Management may at any time by notice, reserve the swimming pool facilities or any part thereof for any reason whatsoever.
5.3
No person suffering from any communicable disease or under the influence of alcohol or drug is allowed to use the swimming pool.
5.4
Spitting or any unhygienic acts in or around the pool or pool deck are prohibited.
5.5
Only swimming and buoyancy aids, which are approved by the attending Life Guard/Supervisor are permitted in the pool.
5.6
All persons must vacate the pools when directed to do so by the attending Life Guard during bad weather. This will be indicated by one blow of the whistle by the Life Guard or by the siren on the Golf Courses.
5.7
Club towels are available at the Pool Towel Counter and must be returned at the Pool Towel Counter, failing which a fee shall be levied for the same,
5.8
No footwear is allowed beyond the yellow line, unless permitted.
5.9
Running on the pool deck is prohibited.
5.10
Swimmers are required to shower before swimming.
5.11
All registration and payments for swimming programs and rentals must be made at the Sports Department. Direct cash payments to the coach or instructor are prohibited.
5.12
The Management shall not be liable for any mishap or injury to person(s), damage to or loss of property/belongings in or around the swimming pool facilities by any cause whatsoever.
5.13
Personal instructors or coaches are prohibited.
5.14
Radios and tape-recorders and musical instruments of any nature are prohibited. However, strictly for private listening, radios and tape-recorders may be used provided that these are used with ear-phones.
5.15
Smoking at pools' deck is strictly prohibited.
5.16
Member is responsible for his own safety including that of his guest(s) and members of his family. The Club and Management will not be responsible for any accident howsoever caused and whether fatal or otherwise to Members, their spouses, children or guests.
5.17
Diving, horseplay, dunking and pushing are prohibited.
5.18
No person should swim at the deep-end unless he or she is able to swim two (2) lengths of the main pool without difficulty. Any person not able to do so must leave the deep-end if requested by the lifeguard or any other authorized personnel
5.19 DRESS CODE
5.19.1
No person is allowed to swim or sunbathe without proper swimming attire. Only swimming attire, which the Management approves, may be worn and in this respect, the Management's decision shall be final.
5.19.2
Changing into or out of a swimming attire must be done in the changing rooms at the pool area only.
5.20 GUESTS
5.20.1
Unless otherwise determined by the Management, Members are allowed to introduce guests based on the following:
WEEKDAYS: A maximum of four (4) guests
WEEKENDS & PUBLIC HOLIDAYS: Members ONLY
REFERRED GUEST(S) MUST BE ACCOMPANIED AT ALL TIMES.
5.20.2
Guest(s) must be registered by the Member at the Swimming Pool Reception/Counter prior to entering the swimming pool area.
5.20.3
Guest(s) shall be charged a fee as may be determined by the Management for the use of the swimming pool through the introducing Member's account.
5.20.4
Guest(s) must display identification tags at all times and when requested to do so by an authorized employee of the Club.
6.0 BOWLING CENTRE
6.1
The Bowling Centre shall be open at such hours and on such days as the Management shall determine from time to time. Notice of the opening hours shall be posted on the Notice Board at the Reception Counter of the Bowling Centre.
6.2
The Management may at any time by notice, reverse all or any lanes for the purpose of holding tournaments, leagues, maintenance or special Club function or any other reason whatsoever.
6.3
The Management reserves the right to discontinue any games if bowlers violate the Rules & Regulations of the Club or behave in a disorderly manner.
6.4
The bowling approach is restricted to bowlers only. The Management reserves the right to request non-bowlers to leave this area.
6.5
Bowlers shall give way to the Bowler on the right when the latter has assumed approach position.
6.6
Bowlers who consistently loft the ball on the lane shall be stopped from further play.
6.7
Bowlers shall not step beyond the foul line.
6.8
Bowlers shall not cross over to the approach area of adjoining lanes.
6.9
No smoking, drinking or eating is allowed on the approach area.
6.10
Bowlers must return house bowling balls to the racks after completing their games. House bowling balls are strictly confined to Bowling Centre and must not be taken outside the Bowling Centre under any circumstances.
6.11
The Management shall not be liable for any mishap or injury to person or persons, damage to or loss of properties/belongings in or around the Bowling Centre by any cause whatsoever.
6.12 CHARGES
6.12.1
Members and their guest(s) shall be liable for the fees and charges for the use of the Bowling Centre, including rental of shoes, which shall be stipulated by the Management from time to time by way of notice posted on the Notice Board at the reception counter of the Bowling Centre.
6.12.2
Member and/or guests shall be liable to pay such penalty charges as shall be determined by the Management for any loss or willful damage of house shoes.
6.12.3
Charges for each game shall be on a maximum basis of 10.5 reset cycles as recorded on the meter counter.
6.12.4
Incomplete games shall be charged on per game basis.
6.12.5
Practice throws shall be charged a flat rate for each frame.
6.12.6
No substitutes are allowed while a game is in progress.
6.13 DRESS CODE
6.13.1
Members and guests are required to be properly attired at all times. Tank tops, singlets and slippers are not allowed.
6.13.2
Only approved bowling shoes and ball may be used on the lanes.
6.14 BOOKING PROCEDURES
6.14.1
Bookings may be made via telephone or walk-in on such days and within such hours as shall be determined by the Management from time to time and posted at the Notice Board at the Reception Counter of the Bowling Centre.
6.14.2
Each advance booking shall be for a maximum of two (2) hours open lane or twelve (12) games. Any extension thereof shall be subject to the availability of lanes.
6.14.3
All block bookings are to be approved by the Management.
6.14.4
Lanes not taken up within five (5) minutes after the reserved time shall be considered as cancelled and the Member shall be liable for a penalty sum, which shall automatically be debited to the Member's account.
6.14.5
A Member who cancels his/her booking less than 24hours before time of play for any reason shall be charged a cancellation fee which shall be automatically debited to the Member's account.
6.14.6
In the event the lane booked by a Member is in the opinion of the Management, not serviceable, the lane shall be declared as non-playable and the penalty under Rule 6.14.4 and 6.14.5 above shall not be applicable.
6.14.7
Time where mentioned in the Bowling Centre Rules shall be in accordance with the clock located at the Bowling Counter.
6.15 LEAGUES/TOURNAMENTS
6.15.1
League Standing Sheets shall be posted on the Notice Board at the Bowling Centre. League averages shall be kept at the Reception Counter and posted on the Notice Board at the Bowling Centre at all times.
6.15.2
Computer printed score sheets may be used only for leagues/tournaments and official competitions.
6.15.3
During leagues/tournaments, practice bowling shall be allowed for a maximum period of three (3) minutes only, after which the machines shall automatically be shut off and pins activated for the leagues/tournaments to commence.
6.15.4
The oiling combination shall be at the sole discretion of the Management.
7.0 FITNESS CENTRE
7.1
Fitness Centre shall be opened at such hours and on such days, as the Management shall determine from time to time. Notice of the operating hours shall be posted at a conspicuous location at the Fitness Centre.
7.2
The Management may at any time close the Fitness Centre or any part thereof for any reason whatsoever.
7.3
Any Member who participates in any physical fitness or health program shall register for such program at the Fitness Centre prior to his/her participation in any such program.
7.4
Members using the Fitness Centre facilities and equipment shall be required to sign in the Register Book provided.
7.5
Members must present their Membership Card to staff on duty or authorized employee of the Club when requested.
7.6
In the interest of safety, the areas of the gymnasium must be kept dry. Members are therefore forbidden from entering the gym while wearing wet clothing or swimming attire.
7.7
No smoking, drinking or eating is permitted in the Fitness Centre.
7.8
For safety reasons, children under fifteen (15) years are not permitted to use this facility.
7.9
Members shall place equipment back in their respective places after use.
7.10
No bags, sports bags, shopping bags or rackets are allowed in the Fitness Centre.
7.11
Members are to use the equipment at the Fitness Centre at their own risk.
7.12
Fitness Centre facilities are strictly for Members' use only. The usage and the time of usage shall be determined at the discretion of the Management from time to time.
7.13
Any Member on finding a malfunction of any equipment should report the matter immediately to the Fitness Centre Attendant.
7.14
The Management shall not be liable for any mishap or injury to person or persons, damage to or loss of property/belongings in or around the Fitness Centre by any cause whatsoever.
7.15
Personal instructor or coaches are prohibited in the Fitness Centre.
7.15 DRESS CODE
7.15.1
Members are requested to dress in an appropriate manner. Jeans and slippers are strictly prohibited.
8.0 THEATRETTE
8.1
The Theatrette shall be open at such time and on such days as shall be posted on the Notice Board by the Management from time to time.
8.2
The Management may at any time by notice reserve or close the Theatrette for any reason whatsoever.
8.3
Movies shown in the Theatrette shall be divided into junior and adult showings.
8.4
In junior showings, children below twelve (12) years old must be accompanied by adult or teenage child above fifteen (15) years of age.
8.5
Members and/or children are to use the designated entrance into the Theatrette and they are required to be seated ten (10) minutes prior to the screening of films.
8.6
No loitering is allowed in or outside the Theatrette or its adjacent area.
8.7
No seats may be booked in advance or held for others.
8.8
Members may bring a maximum of three (3) guests for adult shows at a charge to be determined by the Management.
8.9
Members must ensure that they do not block or obstruct the aisles or the viewing angle of others in the audience.
8.10
Smoking is strictly prohibited in the Theatrette. Snacks and other light refreshments can be signed for during the interval of the shows.
8.11 DRESS CODE
8.11.1
Members and guest(s) are required to be properly attired at all times. Singlets and slippers are not allowed.
9.0 CHILDREN'S PLAYGROUND
9.1
The operating hours shall be at such time and such days as shall be posted on the notice board by the Management from time to time.
9.2
Parents are always responsible for the safety of their children. A child under twelve (12) years is not permitted to use the children's playground unless accompanied at all times by his parents or an adult to whom the parents have delegated the responsibility for his child's safety.
9.3
Smoking is strictly prohibited in the playground.
9.4
Parents will be responsible for the replacement of any item damaged by their children.
9.5
Any child who in the opinion of the Management appears sick or suffering from any illness may not be allowed to use the playground.
9.6
Any toy or item brought in by a child who is considered dangerous by the Management may be confiscated from the child and returned to the parents.
9.7
Only children that are twelve (12) years and below are allowed to use the playground.
9.8
The Management may at its discretion not allow any child to use the children's playground without assigning any reason whatsoever.
9.9
The Management will not be responsible or liable for any missing child, injuries or death caused to any child by any reason whatsoever.
10.0 CHILDREN'S ROOM
10.1
The operating hours shall be at such time and on such days as shall be posted on the Notice Board by the Management from time to time.
10.2
Members are to provide their own babysitters for their own children and shall not ask any employee of the Club to feed a child or accompany a child to the changing room.
10.3
Consumption of food and drinks in the Children's Room is limited to soft drinks and tidbits/snacks provided by Members.
10.4
Members will be responsible for the replacement of any item damaged by their children.
10.5
Any child who in the opinion of the Management appears sick or suffering from any contagious disease shall not be allowed to enter the Children's Room without assigning any reason whatsoever.
10.6
The Management will not be responsible for any missing child or liable for injuries or death caused to any child by any reason whatsoever.
10.7
Smoking is strictly prohibited in the Children's Room.
11.0 CHANGING ROOM
11.1
Unless otherwise determined by the Management from time to time, the changing room facilities shall be opened daily at such hour as shall be posted at the respective facilities.
11.2
The Management may at any time, close the changing rooms or any part thereof for any reason whatsoever, but not all at one time.
11.3
No smoking, eating or drinking is allowed in the Locker Rooms/Changing Rooms.
11.4
Children under fifteen (15) years are not allowed to use the Golfers' changing room. Children under fifteen (15) years shall use the poolside changing room instead.
11.5
Boys over four (4) years shall not be allowed in any of the Ladies' Changing Room.
11.6
Girls of any age are not allowed in any of the Men's Changing Room.
11.7
Club towels are available at the Changing Rooms Counter and must be returned to the counter failing which a fee shall be levied for the same.
11.8
Each Member is entitled to sign out a maximum of two (2) towels per day free of charge. Extra towels will be available at a fee to be determined by the Management. 11.9 Storage of foodstuff, weapons, banned publications, and/or banned drugs in the Changing Room (lockers) are prohibited.
11.10
The Management shall be entitled to charge a fee for replacement of lost or missing locker key.
11.11
All lockers are inspected on a daily basis at 9pm. Any item(s) found will be removed, and the Management shall not be liable in any manner for any loss/damages.
11.12
Members must produce their Membership Cards for verification and registration by the attendant at the Changing Room Counter before issuance of towels and Locker keys.
11.13
Articles deposited in the locker room or left in the changing rooms shall be entirely at the risk of the Members and the Management shall not be responsible for loss or damage to any articles to deposit therein.
11.14 The Club will retain in its custody, the duplicate locker keys and the use of the duplicate keys will only be made in the presence of the Member to whom the locker is allotted.
12.0 CAR STICKERS & CAR PARK
12.1
A Member is entitled to a maximum of two (2) stickers and may apply for additional stickers subject to due compliance with the terms of these By-Laws. The Club stickers are issued for identification purposes and do not confer upon vehicles bearing such stickers an automatic right of entry into the Club.
12.2
Every application for a sticker must be made by the Member submitting to the Club a completed application form prescribed by the Club. The form must be supported by a photocopy of the vehicle registration card in respect of an application for additional stickers.
12.3
Upon approval of an application, a Member shall be issued the stickers applied for only after he/she has paid such cost therefore as may from time to time be determined by the Management and also other dues as may then be due from him/her to the Club. The Club may issue new stickers to replace any lost stickers by imposition of a penalty be determined by the Management.
12.4
A Member must collect his/her car sticker(s) from the Club either personally or through a duly authorized representative.
12.5
Members shall display the valid club stickers on the front windscreen of their vehicles for easy identification.
12.6
Members are responsible for the safe custody of the stickers issued to them. These stickers must be returned to the Club without any refund of the cost:
(a) when they dispose of their vehicle(s); or
(b) when they cease to be members of the Club; or
(c) on demand by the Management
12.7
The Club may at its absolute discretion refuse entry to the Club's premises by any vehicle whether or not such vehicle bears a Club sticker.
12.8
All vehicles permitted to enter the Club shall be parked in respective designated lots or as directed by authorized Club employee or security personnel. Only vehicles with current car stickers are allowed to park at designated lots for Members regardless whether the vehicle(s) belong to Members or otherwise or driven by Members.
12.9
All drivers of any vehicle entering into the Club premises must obey these By-Laws, observe all rules and etiquette and accord due courtesy to Members and other visitors to the Club, not cause any obstruction to any party and comply with all such other regulation as may be enforced by the Club from time to time.
12.10
Without prejudice to any other rights or remedies available to it including the right to take disciplinary action against any infringing Member, the Club may impose a fine of up to fifty (RM50) for each instance of contravention, on any Member or other person who breaches any of these By-Laws or any other regulations as to parking or the control of any vehicle within the Club that may from time to time be in force.
12.11
Vehicle belonging to any Member(s) or person(s) if found to be indiscriminately or wrongfully parked, will be clamped and only be released upon paying a RM50 fine.
12.12
The Club shall not be liable under any circumstances to any persons for any personal injury or death, or for any loss or damage of/or to any vehicle, its accessories or contents to any other property whatsoever while such vehicle is in any part of the Club's premises.
13.0 FOOD & BEVERAGE
13.1
The Food & Beverage facilities or such other facilities as the Management shall determine from time to time are:
(a) Banqueting / Function Rooms
(b) Golfers’ Terrace
(c) Al Fresco
(d) Karaoke Lounge
(e) Members’ Lounge
(f) Drink Huts
(g) Chinese Restaurant
(h) Japanese Restaurant
(i) Western Fine Dining Restaurant
(j) Cigar Lounge
(k) Piano Lounge
(l) D’Swing Café/Kiosk
13.2
The various Food & Beverage facilities shall be opened daily at such hours as posted at the respective Food and Beverage facilities.
13.3
Playing of musical equipment including radio cassette players by person(s) other than the Management is prohibited in all F&B outlets.
13.4
Person(s) in bathing attire are prohibited from entering any of the F&B outlets, excluding the Al Fresco Café.
13.5
Only F&B available on the menu may be ordered and served. Outside Food & Beverages is strictly prohibited.
13.6
Members are not allowed to carry their food and/or drinks to areas other than where it was ordered from.
13.7
Last order shall be taken not later than thirty (30) minutes before closing time.
13.8
Smoking is only allowed at designated areas of the Club.
13.9
No employee of the Club shall be reprimanded or punished by a Member or guest(s).
13.10
Any complaint made against an employee of the Club must be referred to the Management.
13.11
A Member’s or his/her guest’s maid, driver or bodyguards shall be confined to designated areas of the Club premises and shall not be permitted to use any of the facilities and amenities of the Club.
13.12
Members who bring their children must ensure they do not cause any annoyance to other diners, otherwise services will be denied.
13.13
Members shall produce their Membership Cards when required by authorized employee of the Club at any of the Food & Beverage outlets.
13.14
Children under twelve (12) years are not allowed except on permitted occasions or when accompanied by an adult.
13.15
No alcohol and cigarette shall be served to children under the age of eighteen (18) at all Food & Beverage outlets.
13.16
No food and/or drink from outside of the Club are allowed. Duty free liquor is strictly prohibited at all Food & Beverage outlets.
13.17 DRESS CODE
13.17.1
All persons using the Food & Beverage facilities shall be appropriately attired according to the dress codes applicable to each facility:
Banqueting / Function Rooms: Smart casual. No sleeveless shirts, slippers and shorts allowed.
Golfers’ Terrace: Golfing attire is allowed. No collarless/sleeveless shirts and slippers allowed.
Al Fresco: Swimming attire is allowed.
Karaoke Lounge: Smart casual. No sleeveless and slippers allowed.
Members’ Lounge: Smart casual. No collarless/sleeveless shirts, slippers and shorts allowed.
Drink Huts: Only Golfing attire is allowed.
Chinese Restaurant: Smart casual. No sleeveless shirts, slippers and shorts allowed.
Japanese Restaurant: No sleeveless shirts, slippers and shorts allowed.
Western Fine Dining Restaurant: Smart casual. No jeans, sleeveless/collarless shirts, shorts and slippers allowed.
Cigar Lounge: Smart casual only. No shorts, slippers and collarless/sleeveless shirts allowed.
Piano Lounge: Smart casual. No shorts, slippers and collarless/sleeveless shirts allowed.
D’Swing Café: Smart casual and golfing attire is allowed. No collarless/sleeveless shirts and slippers is allowed.
13.18 FUNCTION ROOMS
13.17.1
All persons using the Food & Beverage facilities shall be appropriately attired according to the dress codes applicable to each facility:
13.18.1
Reservation of function rooms may be made by telephone or walk-in, on a first-come-first-serve basis at least thirty (30) days before the date of the function.
13.18.2
Members are required to confirm their reservations not later than seven (7) days before the date of reservation. Upon confirmation, a deposit equivalent to 50% of the total cost of the function shall be payable by the Members. The balance of the total cost of the function shall be settled immediately after the function. The Club shall have the discretion to impose late payment interest on overdue accounts.
13.18.3
A Member is not allowed to debit function and banquet charges incurred into his/her account.
13.18.4
Charges for all private functions shall be on a per-head basis with a minimum guaranteed number of persons. Where there is a minimal attendance, the host Member shall be charged for the agreed minimum guaranteed number of persons. Where there is over attendance, the host Member shall be charged for the actual number of persons attending.
13.18.5
A Member wishing to cancel his/her confirmed reservation must give at least seven (7) days notice in writing to the Management before the date of the function, failing which the deposit shall be forfeited.
13.18.6
It is the responsibility of the Member holding the function to ensure that his/her guests confine themselves to where the function is held.
13.18.7
No charge shall be levied for the use of the Banquet Hall where the total food and beverage costs exceed RM2,500.00. In the event the total food and beverage costs are less than RM2,500.00, the Member shall be charged such sum as shall be stipulated by the Management for the use of the Banquet Hall/Function Rooms.
13.19 KARAOKE LOUNGE
13.19.1
Children below the age of eighteen (18) are not allowed in the public area and at the bar counter of the Karaoke Lounge. However, they may be allowed in the private rooms and must be accompanied by their parents or adults.
13.19.2
No alcohol and cigarette shall be served to children under the age of eighteen (18) in Karaoke Lounge.
13.19.3
The Karaoke Lounge is meant for Members and accompanied guest(s) and any other guests allowed by the Management.
13.19.4
No outside food and/or drinks from outside of the Club are allowed.
13.19.5
No duty free liquor is to be consumed or bring into the Karaoke Lounge.
13.19.6
Private rooms are available on a first come first served basis.
13.19.7
Corkage for every bottle of wine and/or liquor brought in will be charged at a fee to be determined by the Management.
13.9.8
The Pool Tables and dart facilities at the Karaoke Lounge are available for Members’ usage on first come first serve basis.
13.9.9
The Management reserves the right to refuse entry or request any person(s) to leave the Karaoke Lounge if in the opinion of the Management, the conduct and/or attire of such person is against the stated By-Laws.
13.20 MEMBERS’ LOUNGE
13.20.1
The Members’ Lounge shall be opened daily at such hours as may be determined by the Management.
13.20.2
The Management reserves the right to refuse entry or request any person(s) to leave the Members’ Lounge if in the opinion of the Management, the conduct and/or attire of such person is against the stated By-Laws.
13.20.3
Members shall at all time dress the appropriate attire prescribed by the By-Laws herein and/or as posted on the Club premises from time to time.
13.20.4
Members’ Lounge is strictly for the usage of Club Members only. Guest(s) and visitor(s) are strictly prohibited from entering this lounge.
14.0 DISCIPLINARY COMMITTEE
14.1
A Chairman and a minimum of two (2) Committee Members comprising of Club Members that is appointed by the Management to serve in the Disciplinary Committee for a duration of one (1) year.
14.2 OBJECTIVE
14.2.1 The objective of the Disciplinary Committee shall be to:
Instill and promote good discipline, conduct and harmony among all Members of the Club.
Recommend or propose to the Management for its consideration any improvement or amendment to the Club Rules and Regulations, and By-Laws.
Carry out any inquiry relating to the discipline of Members and recommend disciplinary actions, if any, to be taken against any delinquent member.
14.3 POWER OF THE DISCIPLINARY COMMITTEE
14.3.1
The power of the Disciplinary Committee shall be:
To assist the Management in overseeing the good performance and discipline of all the Club Members.
To assist the Management in implementing and enforcing all Club Rules and Regulations, and By-Laws.
To conduct inquiries and recommend to the Management disciplinary actions to be taken against Member’s indiscipline and misconduct.
15.0 MEMBERSHIP COMMITTEE
15.1
A Chairman and one (1) Committee Member comprising of Club Member that is appointed by the Management to serve in the Membership Committee for a duration of one (1) year.
15.2 OBJECTIVE
15.2.1
The objectives of the Membership Committee are as follow:
To deal with membership matters in accordance with the Deed of Trust, Rules & Regulations and By-Laws of the Club, and any discretion which may be given by the Board from time to time.
To review all applications for membership, to decide whether any candidate should be admitted or rejected.
To formulate a prescribed code of conduct for Members and to suggest any revisions from time to time, the better administration of the Club’s Membership affairs.
15.3 POWER OF THE MEMBERSHIP COMMITTEE
15.3.1
The power of the Membership Committee is as follow:
To deal with each application for Membership in order of its receipt by the Club.
To determine whether a candidate be elected to Membership, the Committee shall take into account inter alia the primary objects of the Club as set out in the Deed of Trust and the past practices of the Club. Subject as aforesaid, the Committee shall be entitled to use such criteria as it generally deems fit to determine the fitness of a person for Membership.
The Committee may at its discretion request any candidate for Membership to attend an interview prior to his election.
